These Terms of Service ("Terms") govern access to and use of the Aether Desk website, application, and related services (together, the "Service") operated under the Aether Desk brand ("we", "us", or "Aether Desk"). By creating an account, starting a trial, subscribing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms are a product terms document for software access. They are not a substitute for advice from your own counsel, and they do not create an attorney-client relationship. See also our Privacy Policy and the legal hub for a short risk summary.
1. The Service
Aether Desk provides software that can help you practice strategies with live market data and virtual funds ("paper" / practice mode) and, when you choose and when the product supports it for your region and venue, automate order placement on exchanges that you connect with your own API credentials. We provide software access and tooling. We do not operate a fund, do not give personalized investment advice, and do not act as your broker, dealer, commodity trading advisor, or portfolio manager.
2. No custody; your keys and accounts
- We do not take custody of your crypto assets, fiat, or exchange balances. Capital stays on your exchange account under your control.
- You create and manage API keys on your exchange. You must use trade-appropriate permissions and disable withdrawals on keys used with the Service where the exchange allows it.
- You remain solely responsible for your exchange account, KYC, eligibility on that venue, API key security, IP allowlists, passphrase storage, risk settings, position sizing, and tax reporting.
- If you share keys, lose control of your device or password, or misconfigure exchange permissions, losses may follow. We are not responsible for unauthorized use of keys you provide.
3. Paper (live-market practice) vs live trading
- Paper / live-market practice mode uses live market data with virtual capital (simulated fills and books) for practice. It is not a live trade on an exchange. Practice performance can differ materially from live results (latency, liquidity, fees, funding, partial fills, rejects, and your own arming choices).
- Live trading places real orders on an exchange you connect. Live execution stays off until you explicitly arm it in the product (and until other gates such as subscription, region, and venue support are satisfied).
- Availability of a connector, venue label, or "go live" path does not guarantee that you are eligible on the exchange or under local law. Complete exchange requirements and follow applicable rules.
4. Risk disclosure (futures and crypto)
Cryptocurrency and futures trading involve a high degree of risk and may not be suitable for everyone. You can lose some or all of the capital you allocate. Leverage amplifies both gains and losses. Markets can move quickly; gaps, liquidations, exchange outages, API failures, and forced de-leveraging can occur.
NFA-style futures risk notice (adapted for crypto futures / perpetual products): Futures and leveraged crypto derivative trading is speculative. You should only trade with capital you can afford to lose. Past performance, whether live or simulated, is not necessarily indicative of future results. There is no guarantee that any strategy, sleeve, backtest, or desk configuration will be profitable or will avoid loss.
Nothing on the Service is investment, legal, tax, or accounting advice. If you are unsure, do not trade futures or subscribe.
5. Eligibility and geographic restrictions
You must be able to form a binding contract and be old enough under the laws of your country of residence. Retail futures bot signup through Aether Desk is not offered in the United States or the United Kingdom. Checkout and signup may be blocked for those jurisdictions. You represent that the country you select is accurate and that you will not circumvent regional controls.
Exchange connectors and product options differ by region (for example EEA vs other markets). See in-product region messaging and our FAQ for current venue notes. Support may also explain venue-specific product differences (such as OKX EEA X-Perps vs classic USDT-M margin); those operational notes are not marketing claims.
6. Accounts, trial, and subscriptions
- You must provide accurate account information and keep your login credentials secure.
- New accounts may receive a limited free live-market practice trial as described at signup and pricing. After the trial, continued access requires an active paid plan (for example Starter or Pro) unless we state otherwise.
- Subscription fees are for software access, not for a share of trading profits, not for investment advice, and not for a managed account. Plan features, strategy unlocks, and capital caps are described on the pricing page and may change with notice where required.
- Payments are processed by Stripe (card and other methods Stripe supports). Annual crypto checkout may be processed by NOWPayments. We do not store full card numbers on our servers.
- Unless a mandatory consumer law says otherwise, fees are generally non-refundable once the billing period has started, except where we cancel the Service for convenience or are required to provide a refund. You may cancel future renewal where the billing provider and product allow it; access continues until the end of the paid period unless we state otherwise.
7. Acceptable use
You agree not to:
- Use the Service for unlawful activity, market abuse, or sanctions evasion.
- Attempt to reverse engineer, disrupt, overload, or bypass access controls.
- Misrepresent simulated results as live results in a way that misleads others.
- Resell or sublicense the Service except as we expressly allow (for example an approved affiliate program).
- Use the Service if you are in a blocked jurisdiction for this product.
8. Intellectual property
We and our licensors own the Service, branding, software, and content we provide. You receive a limited, revocable, non-exclusive license to use the Service for your own trading-related use under these Terms. You retain ownership of your account data and credentials subject to our Privacy Policy.
9. Third-party services and exchanges
The Service depends on third parties including hosting, databases, payment processors, and exchanges you choose. Their terms and availability apply independently. We are not responsible for exchange downtime, rejected orders, liquidations, fee schedules, or changes to exchange APIs or product eligibility.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, profitable trading, or that automated orders will always be placed, filled, or cancelled as intended.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AETHER DESK AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST TRADING OPPORTUNITY, LOST DATA, OR EXCHANGE LOSSES, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE SUBSCRIPTION FEES YOU PAID TO US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED EURO (€100).
Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the maximum extent permitted. Nothing in these Terms excludes liability that cannot be excluded under applicable law (for example fraud or certain consumer rights).
12. Indemnity
You will defend and indemnify Aether Desk and its operators against claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your exchange activity, your API keys, your violation of these Terms, or your violation of law, except to the extent caused by our willful misconduct.
13. Suspension and termination
We may suspend or terminate access if you breach these Terms, if required by law, if payments fail, or if continued access would create security or compliance risk. You may stop using the Service and cancel your subscription as described in product billing flows. Provisions that by nature should survive (including risk disclosures, disclaimers, liability limits, and indemnity) survive termination.
14. Governing law and disputes
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the laws of the Netherlands, without regard to conflict-of-law rules. The competent court of the Netherlands has exclusive jurisdiction over any such dispute. Before starting formal proceedings, please contact us at info@aetherdesk.io so we can try to resolve the matter in good faith. Nothing in this section removes mandatory consumer protection rights you may have under the law of your country of residence, including the right to bring proceedings in your local courts where applicable.
15. Changes
We may update these Terms from time to time. The "Last updated" date will change. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance of the updated Terms, except where applicable law requires a different process.
